TURKEY REVIEWS AND REIMPOSES COUNTERVAILING DUTY ON PET FILMS FROM INDIA


As a result of the subsidy investigation completed with the Communiqué on Prevention of Unfair Competition in Imports published on the Official Gazette No: 27177 dated 22/3/2009 a countervailing duty from 4,25% to 21,61% of CIF price entered into force against “PET Films” originating in India.

In accordance with the second paragraph of 35th Article of the Regulation on Prevention of Unfair Competition in Imports, it was announced with the Communiqué on Prevention of Unfair Competition in Imports published on the Official Gazette No: 28692 dated 29/6/2013 (Communiqué No: 2013/11) that measures against said product will end at 22/3/2014 and domestic industry can demand an expiry review investigation to be initiated with an application supported by sufficient evidence within the period stipulated in the legislation.

With the allegation that in case of termination of the measures in force re-occurance of injury and subsidy is probable, an application was made by domestic producer Süper Film Ambalaj Sanayi ve Ticaret A.Ş. (Süper Film) and supported by Polinas Plastik Sanayii ve Ticareti A.Ş. (Polinas).

The expiry review investigation which was initiated with the Communiqué on Prevention of Unfair Competition in Imports published on the Official Gazette No: 28948 dated 21/3/2014 (Communiqué No: 2014/6) and conducted by the General Directorate of Ministry of Economy has been completed. Countervailing duty is decided to implemented with the decision of Evaluation Committee of Unfair Competition in Imports and the approval of the Minister of Economy at rates ranging from 4,25% and 21,61%.
